Annual Compliance Assessments for Statutory Code of Practice 2024/25
The Scottish Biometrics Commissioner Dr Brian Plastow has recently written to Police Scotland, the SPA, and the PIRC confirming that they are currently complying with the Commissioner’s statutory Code of Practice. In the case of Police Scotland, this is conditional on satisfactory progression of recommendations made jointly with Scottish Government about reviewing its biometric retention policy in Scotland by October 2025.
The Commissioner said, “since the Code of Practice was approved by the Parliament and brought into legal effect on 16 November 2022, we have received no complaints from data subjects relative to the Code. I wish to congratulate Police Scotland, the SPA, and the PIRC for their rigorous self-assessment activity to ensure that they continue to comply with the statutory Code of Practice in Scotland, thus ensuring that biometric data is used in a lawful, effective, and ethical manner’.
